Privacy Policy & SMS Consent
What we collect when you request a health insurance quote, how we protect it, who we share it with, and how to opt out of text messages or have your data deleted.

1. Who we are and what this policy covers
Swierc Health is an independent, licensed health insurance agency. This Privacy Policy explains what information we collect when you request a quote, complete our qualifier, call or text us, or use this website; how we use and protect that information; who we share it with; and the choices you have, including how to opt out of text messages and how to ask us to delete your data.

2. Information we collect
- Contact information
- Your name, mobile and other phone numbers, email address, mailing address or ZIP code, and preferred contact method and times.
- Quote and eligibility information
- Household size, dates of birth or ages, state and county, tobacco use, expected household income for the coverage year, employment or self-employment status, business size for group quotes, current coverage, doctors and prescriptions you want covered, and the coverage start date you need. This information is used to determine which plans and subsidies you qualify for.
- Health-related information
- Only what you volunteer or what an application requires — for example prescriptions, providers, or medical history required by a carrier for underwritten products such as private, short-term, or life coverage. We do not ask for medical records to give you a quote.
- Qualifier and campaign data
- Your answers to our short qualifier and the campaign parameters attached to your session (for example utm_source, utm_medium, utm_campaign, utm_content, utm_term) so your quote reflects the answers you already gave.
- Website and device data
- IP address, browser and device type, pages viewed, referring URL, and similar analytics data collected through cookies and Google Analytics.
3. Why we collect phone numbers and how we use them
Your business relationship with us is built on being able to reach you. Swierc Health collects mobile phone numbers for the purpose of sending transactional messages (for example appointment and consultation reminders, quote deliveries, application and enrollment status updates, missing-information requests, renewal and deadline notices) and promotional messages (for example open enrollment reminders, new plan or carrier availability, special offers, and occasional educational updates).
- You provide your phone number and SMS consent voluntarily through our contact, quote, or qualifier forms, by phone, or in writing.
- SMS consent is never a condition of purchasing any insurance product, receiving a quote, or getting help from us.
- Message and data rates may apply. Message frequency varies.
- You can opt out at any time by replying STOP to any message, and get help by replying HELP or contacting us at (361) 264-4055.
4. SMS consent & data sharing
We highly value your privacy. Your personal information, including mobile numbers and SMS consent, will never be shared with or sold to third parties or affiliates for marketing or promotional purposes.
If you have opted in to receiving text messages from us, we will use your mobile number solely for the purpose of communicating with you regarding your service appointments, quotes, essential account updates, and occasional promotional messages.
Consent sharing
Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
Aggregators, carriers, and messaging platform providers receive only what is technically necessary to deliver and document your messages, and they are contractually restricted to that purpose. They may not use your number for their own marketing.
5. How we use your information
- To prepare written, side-by-side comparisons of the health insurance plans you qualify for.
- To submit applications, subsidy determinations, and enrollments to carriers, the federal or state Marketplace, or general agencies on your behalf and at your direction.
- To provide ongoing service: renewals, ID card and billing questions, provider and prescription checks, claims and appeals support, and life-event changes.
- To send the transactional and promotional messages described above through the channels you consented to.
- To meet insurance licensing, suitability, recordkeeping, and anti-fraud obligations, and to comply with applicable state and federal law.
- To measure and improve our website and marketing using aggregated analytics.
We do not sell your personal information. We do not share your information with unrelated third parties for their own marketing, and we do not use your health information for marketing purposes.
7. How your data is stored and protected
- Records are kept in access-controlled, password-protected systems with encryption in transit (TLS) and encryption at rest provided by our hosting and CRM vendors.
- Access is limited to the licensed agent and authorized staff who need the information to serve you; accounts use unique credentials and multi-factor authentication where the vendor supports it.
- Sensitive documents are transmitted through secure forms or e-signature tools rather than unsecured email whenever possible; please do not email full Social Security numbers or medical records.
- We retain quote, application, and consent records for as long as needed to service your coverage and for the period required by insurance and tax recordkeeping rules, then delete or de-identify them.
- We maintain written records of your SMS opt-in and any opt-out so consent can be documented and honored.
- No system is perfectly secure. If a breach affecting your information occurs, we will notify you as required by applicable law.
8. Your choices, access, and deletion requests
- Text STOP to any message from us to stop all text messages; you will receive one confirmation message and then no further texts.
- Text HELP to any message, or contact us directly, for assistance with the messaging program.
- Ask us to correct your information, limit contact to email or phone only, or unsubscribe from marketing email using the link in any email.
- Request a copy of the information we hold about you, or ask us to delete it, by emailing info@swierchealth.com or calling (361) 264-4055. We will confirm your identity and respond within 30 days.
- Deletion note: records tied to an active policy, a submitted application, or an insurance recordkeeping requirement may need to be retained; we will delete everything we are not legally required to keep, and we retain a minimal opt-out record so we do not text you again.
- Depending on your state, you may have additional rights to access, correct, delete, or opt out of certain processing. We honor those rights without discrimination.
10. Children and third-party sites
This site is intended for adults. We do not knowingly collect information from children under 13 except as part of a parent's or guardian's family coverage application. Carrier, Marketplace, and other linked sites have their own privacy policies, and we are not responsible for their practices.
11. Changes to this policy
We may update this Privacy Policy to reflect changes in our practices or the law. The effective date above shows the current version. Material changes affecting how we use your phone number or SMS consent will be posted here before they take effect.
