Terms of Service & SMS Program Terms
The rules for using this site and working with Swierc Health, including full SMS program terms, disclosures, and how to opt out or get help.

1. Agreement to these terms
These Terms of Service govern your use of swierchealth.com and the quote, qualifier, phone, email, and text-message services provided by Swierc Health, an independent licensed health insurance agency. By using this site, submitting a form, or communicating with us, you agree to these terms. If you do not agree, please do not use the site or submit your information.
2. What we do — and what we do not do
- We are an independent insurance agency and broker. We help you compare, apply for, and enroll in health, dental, vision, supplemental, and life insurance products offered by third-party carriers.
- We are not an insurance carrier. We do not underwrite policies, set premiums, approve applications, determine subsidy eligibility, or pay claims — the carrier and, where applicable, the federal or state Marketplace do.
- Coverage exists only when a carrier issues a policy and the required premium is paid. Nothing on this site or in any message from us is an offer of coverage or a guarantee of eligibility, rate, network status, or claim payment.
- Plan availability, benefits, networks, formularies, and premiums vary by state, county, effective date, and carrier filing, and are governed solely by the policy documents the carrier issues.
- We are not affiliated with or endorsed by any government agency, and we are not the Health Insurance Marketplace.
3. SMS communications program
By opting in to our SMS communications on our contact, quote, or qualifier form — or by giving your consent verbally or in writing — you agree to our SMS program terms:
- Program name & description
- Swierc Health offers an SMS program to send appointment and consultation reminders, quotes and plan comparisons, application and enrollment status updates, missing-information and document requests, renewal and enrollment-deadline notices, and occasional promotional messages such as new plan availability, special offers, and educational updates, to customers and prospects who have explicitly opted in. You will receive both transactional and promotional messages.
- Message frequency
- Message frequency varies depending on your quote, application, and enrollment activity and on the inquiries you send us.
- Pricing
- Message and data rates may apply. Check with your mobile carrier for details.
- Opt-out & help
- You can cancel the SMS service at any time. Just text "STOP" to the short code or phone number you received messages from. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time. For assistance, reply "HELP" at any time.
- Customer support
- If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at info@swierchealth.com or by calling (361) 264-4055.
- Carrier liability
- Carriers are not liable for delayed or undelivered messages.
- Consent is not a condition of purchase
- Consent to receive text messages is not required to buy any insurance product, receive a quote, or get help from us. You may ask us to contact you by phone or email only.
- Eligibility & your number
- You must be 18 or older and the owner or authorized user of the mobile number you provide, and you agree to tell us promptly if that number changes or is reassigned. Supported carriers may change without notice.
- Privacy
- Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services. See our Privacy Policy for full details.
Do not text sensitive details
SMS is not a secure channel. Please do not send Social Security numbers, full payment card details, or medical records by text — we will provide a secure form or e-signature link instead.
4. Your responsibilities and accurate information
- Provide complete and accurate information on quotes and applications. Insurance applications are legal documents; incorrect ages, income, tobacco use, residence, or medical answers can change your rate, delay enrollment, or cause a carrier to rescind coverage or deny claims.
- Report changes such as income, household size, address, or employment promptly, since they affect subsidy eligibility and plan availability.
- Review the carrier's policy documents, Summary of Benefits and Coverage, provider directory, and drug formulary before and after enrolling, and confirm your providers and prescriptions directly with the carrier.
- Pay premiums directly to the carrier or Marketplace by their due dates. We never require payment for our advisory services, and we do not accept cash.
- Use this site lawfully: no scraping, reverse engineering, automated submissions, spam, malware, or attempts to access accounts or data that are not yours.
5. Consent to be contacted
When you submit a form, call, or text us, you agree that Swierc Health and its licensed agent may contact you at the phone number, email address, and mailing address you provide — including by autodialed or prerecorded calls and text messages where you have consented — about health insurance options, your quote, your application, and your renewal. This consent applies even if your number is on a state or federal Do Not Call list, because you are requesting information from us. You may withdraw consent at any time by replying STOP to a text, asking us to stop calling, or contacting us at info@swierchealth.com.
6. No medical, legal, or tax advice
Content on this site, in our guides, and in our messages is general education about insurance products. It is not medical advice, legal advice, or tax advice, and it does not account for every fact about your situation. Subsidy and tax-credit estimates are projections based on the information you give us; your actual credit is reconciled by the IRS when you file. Consult a physician, attorney, or tax professional for advice in those areas.
7. Compensation and independence
Our advisory service is free to you. We are typically compensated by commissions paid by the carrier you choose, at rates set in the carrier's filed premium — you do not pay more by working with us. We are appointed with multiple carriers and recommend based on your needs, providers, prescriptions, and budget, not commission. We can disclose our appointments on request.
8. Intellectual property
The Swierc Health name, logo, site design, text, graphics, and interactive coverage map are owned by Swierc Health or its licensors and are protected by copyright and trademark law. You may view, download, and print pages for your personal, non-commercial use. Any other reproduction, republication, or commercial use requires our written permission. Carrier names and logos remain the property of their owners.
9. Third-party links, forms, and tools
Our quote forms, chat, scheduling, e-signature, analytics, and messaging features are provided by third-party vendors, and some links take you to carrier or government sites. We do not control those services, and their terms and privacy policies apply to your use of them. We are not responsible for their content, availability, or decisions.
10. Disclaimers and limitation of liability
This site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. Rates, plan details, and deadlines change and may be out of date on any given page.
To the fullest extent permitted by law, Swierc Health and its agent are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost coverage opportunities, arising from your use of this site, from delayed or undelivered messages, or from a carrier's or Marketplace's underwriting, eligibility, network, billing, or claims decision. Our total liability for any claim relating to this site or our services is limited to $100 or the amount you paid us, whichever is greater. Nothing here limits liability that cannot be limited under applicable insurance law.
11. Accessibility commitment
We are committed to making this site usable by everyone and work toward conformance with WCAG 2.1 Level AA and the ADA. Every page includes an accessibility menu (the accessibility button in the lower-left corner) with controls for larger text, high contrast, links underlining, reduced motion, larger cursor, and a reading guide. 12. Complaints, governing law, and changes
- Concerns about your coverage should go to your carrier first; you may also contact your state department of insurance. We will help you document and escalate a complaint.
- These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts serving that jurisdiction unless applicable law requires otherwise.
- If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
- We may update these terms at any time; the effective date above shows the current version, and continued use of the site means you accept the updated terms.
